If my non compete stated 2 or 3 miles that's would've been fine. But 7 was too far. It pushed me from my city and 3 surrounding cities

A noncompete from anyone, whether 1099 or W2, cannot push a person out of work out of the city they live in in their specific industry. If it is the trade that provides for the person's livelihood, no matter what the noncompete says, it cannot prevent a person from working where they live in order to survive. Any judge any where will not allow it, as it would literally prevent a person from surviving. A few miles can be understandable, but to completely push them out of their city or neighboring cities with 25 miles will never stand up in court. From experience, I signed a noncompete of 7 miles, my city is only 4 miles at its widest. Even the 7 miles didnt stand and the judge didnt even allow it to court. He actually schooled the shop owner in his chambers when she tried to push it. He said exactly that, you cannot force a person to not work in their trade in their own city of residence. You force them to be homeless of you do
